Fair Use & API Usage Policy

1) Scope & Incorporation

This Fair Use & API Usage Policy (“Policy”) governs how you access and use features of our Service that call third-party providers as well as our own infrastructure that supports those calls (together, the “API Features”). This Policy is part of our Terms of Service. If there’s a conflict, the Terms of Service control.

2) Metering & Allowances

Usage of API Features is measured by units we define (for example, credits, tokens, images, requests, GPU-seconds, or similar) (“Units”). Your plan may include an allowance of Units. Allowances are provided on a reasonable-efforts basis, are not a guarantee of capacity, latency, or availability, and may be subject to hard or soft limits at our discretion.

3) Dynamic Adjustments

  • Quota & Rate Changes. We may modify per-user, per-workspace, or per-plan allowances, rate limits, burst limits, concurrency, priority, or resolution/quality settings at any time to protect platform stability, manage costs, or ensure equitable access.
  • Immediate Controls. We may throttle, queue, degrade quality, temporarily pause, or block usage immediately (including mid-cycle) if we detect excessive load, suspected abuse, violations of this Policy or our Terms, or third-party policy risk. Where practicable, we’ll provide notice; however, immediate action may occur without notice.
  • Metering Changes. We may change how Units are calculated (e.g., model-, size-, or provider-specific multipliers) and how allowances convert across providers or features. Changes can apply prospectively and, where necessary to preserve service integrity or comply with law/provider terms, during the current cycle.

4) Third-Party Providers & Compliance

API Features may call third-party services. You must comply with all applicable provider terms, usage rules, and content policies. We may enable, modify, or disable specific models or endpoints to remain compliant. Third-party outages, limits, or policy changes may affect your access and are outside our control.

5) Fair Use Expectations

Fair use means using API Features in a way that does not unreasonably affect other users or platform stability. Without limiting our Terms of Service, unfair use includes: attempting to bypass or manipulate rate limits; automated scraping or farming of requests; reselling or sub-licensing the API Features without permission; content or activity that violates law or third-party rights; and any use that materially deviates from typical patterns for your plan.

6) Enforcement

  • We may throttle, queue, degrade quality, suspend features, or suspend/terminate accounts for violations of this Policy or our Terms.
  • We may require plan changes, usage adjustments, or other remediation before restoring access.

7) Changes to this Policy

We may update this Policy from time to time. Material changes will be communicated through the Service or by email. Continued use of API Features after an update constitutes acceptance of the updated Policy.
